Terms and Conditions

1. Scope

These terms apply to all contracts concerning the FabStream software between Fabcom, owner Fabrizio Grande, Oberdorfstrasse 14, 5415 Nussbaumen, Switzerland ("we") and customers ("you"). Use of the software is additionally governed by the End User License Agreement (EULA).

2. Services

  • FabStream Free: free use of the software, including simultaneous output in 16:9 and 9:16 with one streaming destination each.
  • FabStream Premium: paid subscription with multistreaming (up to 3 destinations per format), output settings up to 1440p and 120 fps, replay buffer up to 5 minutes and email support; can be activated on 1 PC of your own.
  • FabStream Ultra: like Premium, plus up to 8 destinations per format, output settings up to 4K and 240 fps, replay buffer up to 10 minutes; can be activated on up to 3 PCs of your own at the same time.
  • FabStream Max: like Ultra, plus replay buffer up to 30 minutes, early access to preview features and priority support; can be activated on up to 5 PCs of your own at the same time.
  • Resolution and frame rate describe the highest settings a plan unlocks. The performance actually achieved (frame rate, dropped frames) depends on your hardware, drivers, other running software and your internet connection and is not guaranteed.
  • Features and values marked “Beta” on the website (e.g. output above 1080p60, more than 3 destinations per format) can be used but are still being tested; they may not reach the stated settings on every PC.
  • The respective providers are responsible for the operation of the streaming platforms (Twitch, YouTube, TikTok etc.); their terms apply.

3. Conclusion of contract

FabStream subscriptions are sold through our online reseller Lemon Squeezy, LLC (USA) ("Lemon Squeezy"). Lemon Squeezy is your contractual partner for the purchase (Merchant of Record), issues the invoice and handles payment, taxes, cancellation and refunds under its buyer terms. You receive the right to use the software (license under the EULA) and support from us. After completing your order you receive the license key on the confirmation page and by email.

4. Prices and payment

The prices shown on the website apply (monthly or yearly). All prices are final prices including any applicable VAT. Payment is made in advance for the respective term via Lemon Squeezy.

5. Term and cancellation

The subscription renews automatically for the chosen term (1 month or 1 year) unless you cancel it beforehand. You can cancel at any time on the account page ("Manage billing"); cancellation takes effect at the end of the paid term. Your plan remains active until then. Periods already paid for are not refunded pro rata unless the law provides otherwise.

6. Right of withdrawal for consumers in the EU

Withdrawal and refunds are governed by the buyer terms of Lemon Squeezy as the seller. For digital content, the right of withdrawal may expire if you agree to immediate provision. If you have any questions, please contact support@fabcomstudios.com – we will help you with Lemon Squeezy.

7. Availability

The software runs locally. To keep a paid plan unlocked, an internet connection for the license check is required at least every 7 days. We strive for high availability of the license server but do not guarantee any particular availability.

8. Warranty and liability

We are liable without limitation for intent and gross negligence and under mandatory statutory provisions (e.g. product liability, personal injury). Otherwise, liability is – to the extent permitted by law – limited to the foreseeable damage typical for the contract and to no more than the fees paid in the last 12 months. You are responsible for the content you stream or record.

9. Changes

We will notify you by email of any price or service changes for running subscriptions at least 30 days before they take effect; until then you can cancel with effect from the end of the term.

10. Governing law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of your country of residence remain unaffected. The place of jurisdiction for merchants is the provider's place of residence (Nussbaumen, district of Baden AG).
